Service Terms Summary
By accessing or using Care Nomads, you agree to comply with all platform rules, cancellation windows, payment terms, and user conduct guidelines. These terms govern both caregiving marketplace services and equipment rentals.
Care Nomads ("Company," "we," "us," "our") operates the website and digital platform ("Site"). By accessing, browsing, registering for, or using any part of this Site, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Site.
Acceptance of Terms
By creating an account, placing a booking request, reserving medical equipment, or registering as a caregiver or delivery provider, you confirm your acceptance of these Terms and all incorporated policies, including our Privacy Policy.
Eligibility & Identity Verification
You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to register an account or request services on Care Nomads. By registering, you warrant that all information supplied is accurate and complete.
Account Security & Registration
- You are solely responsible for maintaining the confidentiality of your login credentials.
- You must notify Care Nomads immediately of any unauthorized access to your account.
- We reserve the right to suspend or terminate accounts that provide fraudulent or inaccurate details.
Services Offered & Regional Operating Models
United States Operations
In the US, Care Nomads operates as a referral and booking marketplace connecting families directly with independent caregivers. Care Nomads is not a licensed home health agency in the US.
Canada Operations
In Canada, Care Nomads operates as a licensed Temporary Help Agency under the Employment Standards Act, 2000, assigning agency employees to fulfill client shift requests.
Payments, Fees & Billing
All payment processing for caregiving shifts, equipment rentals, and contractor payouts is handled securely via Stripe. By placing a booking, you authorize Care Nomads to charge your designated credit card or payment method.
Cancellations & Refund Policy
Cancellations made more than 24 hours prior to shift start are refunded minus a 5% processing fee. Cancellations made within 24 hours incur a charge equal to 2 hours of scheduled service to compensate the assigned caregiver.
All scheduled visits are subject to a 3-hour minimum shift requirement. Cancellations with less than 24 hours' notice are billed at standard rates for the 3-hour minimum.
Equipment Rental Terms
- Renters agree to inspect mobility equipment upon delivery and report any defects immediately.
- Renters assume all operating risks and authorize replacement cost charges for unreturned or destroyed equipment.
User Conduct & Off-Platform Prohibitions
Users agree not to solicit, hire, or pay caregivers outside of the Care Nomads platform. Circumventing platform payment engines will result in immediate account termination and liquidated damages.
9. Disclaimer of Warranties
The platform is provided "as is" and "as available" without warranties of any kind, express or implied.
10. Limitation of Liability
To the maximum extent permitted by law, Care Nomads is not liable for indirect, incidental, or consequential damages arising from independent caregiver performance or equipment operation.
11. Indemnification
You agree to indemnify and hold harmless Care Nomads from any claims resulting from your violation of these Terms or platform misuse.
12. Governing Law
For US users, these Terms are governed by the laws of Maryland, USA. For Canadian users, these Terms are governed by the laws of Ontario, Canada.
